Chapter 153.09 - Zoning Ordinance - Manufactured Housing

§ 153.09.1 Definitions

(a). The following definitions shall apply to this chapter:

Anchoring System: An approved system of straps, cables, turnbuckles, chains, ties, or other approved materials used to secure a manufactured or mobile home to ground anchors.

Foundation Siding (Skirting): A type of wainscoting constructed of fire and weather resistant material, such as aluminum, treated pressed wood or other approved materials, enclosing the entire undercarriage of the manufactured or mobile home.

Manufactured Housing Construction and Safety Standards Code: Title IV of the 1974 Housing and Community Development Act (42 U.S.C. 5401 et seq.), as amended (previously known as the Federal Mobile Home Construction and Safety Act), rules and regulations adopted thereunder, which include HUD-approved information supplied by the home manufacturer, and regulations and interpretations of said code by the Indiana Administrative Building Council.

Mobile / Manufactured Home Park: An area of land on which four (4) or more mobile or manufactured homes are regularly accommodated with or without charge, including any building or other structure, fixture or equipment that is used or intended to be used in providing that accommodation.

Occupied Space: The total area of earth horizontally covered by the structure, excluding accessory structures, such as, but not limited to, garages, patios, porches and hitches.

One-and-Two-Family Dwelling Code, Indiana: The mandatory statewide building code adopted by the Indiana Administrative Council for one-and-two-family residential dwellings.

Public Law 3153.070, Acts of 1971: Enabling legislation requiring the Indiana Building Council to adopt rules and regulations for the construction, repair or maintenance of factory-constructed one-or-two-family residential dwellings.

Recreational Vehicle: A portable vehicular structure not built to the Federal Manufactured Housing Construction and Safety Standards Code or the ANSI 119.1 Mobile Home Design and Construction Standards, as amended, designed for travel, recreational camping or vacation purposes, either having its own motor power or mounted onto or drawn by another vehicle, and including, but not limited to, travel and camping trailers, truck campers, and motor homes.

Special Exception Permit: A device for permitting a use within a district other than a principally permitted use.

§ 153.09.2 Standards for Individual Placement

(a). Permitted Placement: The establishment, location and use of manufactured homes, including mobile homes, as individual scattered-site residences shall be permitted in any zone permitting installation of a dwelling unit subject to requirements and limitations applying generally to such residential use in the district and provided such homes shall meet the following requirements and limitations:

(1). The home shall meet all requirements applicable to single-family dwellings and possess all necessary improvement location, building and occupancy permits and other certifications required by the code;

(2). The home shall be larger than nine-hundred and fifty (950) square feet of occupied space or meet the minimum square footage requirements for the appropriate zone;

(3). The home shall be attached and permanently anchored to a permanent foundation in conformance with the regulations in the Indiana One-and-Two-Family Dwelling Code and with the manufacturer's installation specifications;

(4). The home shall be covered with an exterior material customarily used on site-built residential dwellings, as required by §153.06.29., "Aesthetic Requirements" of this Ordinance, and such material shall extend over the top of the foundation or meet the community's site-built residential dwelling home standards; such as fiberglass, shake, asphalt or tile, which shall be installed onto a surface appropriately pitched for the materials used (amended January 6, 1998 by Ordinance # 98-02).

(b). Placement With Permit: Mobile homes, as well as any manufactured homes, that do not meet the terms of paragraph (a), shall be permitted within the City of Garrett only after receiving a special exception permit from the body authorized to grant special exception permits.

(c). Structural Alteration: Due to its integral design, any structural alteration or modification, proposed for a manufactured or mobile home after it is placed on a site may be allowed only after the granting of a special exception by the Board of Zoning Appeals. (amended August 20, 1996 by Ordinance # 96-15).

(1). An existing site-built dwelling may not be expanded by adding on all, or a portion of, a modular or manufactured dwelling unit.

§ 153.09.3 Mobile Home and Manufactured Home Parks

(a). May be permitted in any district other than a MH district only after receiving a use variance by the Board of Zoning Appeals (amended January 6, 1998 by Ordinance # 98-02) .

(b). Such parks must have a minimum of five (5) acres.

(c). Such parks shall be classified as "Planned Developments" and shall therefore be reviewed and processed under Chapter 153.07, "Planned Developments," of these regulations. In addition, the following requirements shall apply to mobile and manufactured home parks:

(1). The design of such developments must be approved by the Indiana State Board of Health before an Improvement Location Permit may be issued.

(2). All homes within the development shall meet the requirements and limitations as described in Section 153.11.2, "Standards for Individual Placement."

(3). The park shall be provided with street lighting.

(4). The minimum lot area for each manufactured housing unit shall be five-thousand (5,000) square feet. (Amended by Ordinance # 96-4).

(5). The minimum lot width shall be fifty (50) feet. (Amended by Ordinance # 2293).

(6). All driveways, access roads, streets and lanes within the park shall be identified by some means to efficiently provide safe fire, police and emergency vehicle access.

(7). In the event the developer proposes to establish driveways or streets within the mobile home park as public streets, the design shall meet the minimum standards as prescribed in Subdivision Control Ordinance. All streets, driveways, sewers and waterlines installed within the Manufactured Housing Development shall meet the minimum design specifications prescribed by the Garrett Subdivision Ordinance. (Amended by Ordinance # 8691).

(8). At least five hundred (500) square feet per living unit shall be reserved for open / recreation space areas; this figure is in addition to any private open areas created by yard requirements.
