Chapter 153.02 -
These zoning regulations have been developed to ensure that adequate space, light, air, convenience of access, safety from fire, floods and other dangers exists for all buildings and properties within the City of Garrett, Indiana, and, as designated, the Garrett Plan Jurisdiction; to prevent congestion and private development with the public rights-of-way; and to maintain and enhance the general health, safety, morals and quality of life of the community .
These zoning regulations have been developed and amended with reasonable regard to existing land uses, the character of buildings and development within each zoning district, to the most desirable land uses within each zoning district, and to the conservation and enhancement of property values throughout the Garrett Plan Jurisdiction.
These Zoning Regulations shall also be known and referred to within the text as both "Zoning Ordinance" and "Ordinance", unless the context specifically states otherwise. (Amended by Ordinance # 2293).
Be it ordained by the Common Council of the City of Garrett, Indiana, that (Amended by Ordinance # 2293):
These regulations are pursuant to the authority vested in the City of Garrett, Indiana by the IC 36-7-4-600 Series, as amended. (Amended by Ordinance # 2293).
The provisions of these regulations shall be interpreted to be, and applied as, the minimum requirements for the purposes of §153.02.1. The City of Garrett, Indiana Plan Commission has given careful consideration to the probable future use of land in the area governed by these regulations, and has prepared a comprehensive plan illustrating the future projected development of this area. The goals, objectives and policies established within the comprehensive plan have guided the preparation of these regulations. (Amended by Ordinance # 2293).
These regulations shall apply to all land within the City of Garrett, Indiana, and all unincorporated land within the Garrett Plan Jurisdiction as designated by legal description, by ordinance, by the Common Council of the City of Garrett, Indiana. (Amended by Ordinance # 2293).
§ 153.02.6 Non-Interference With Greater Restrictions Otherwise Imposed
It is not intended by these regulations to interfere with, or abrogate, or annul, any easements, covenants, or other agreements between parties, nor to interfere with, or abrogate or annul any ordinances, rules, regulations or permits previously adopted or issued, and not in conflict with any of the provisions of these regulations, or which shall be adopted or provided, except, that where these regulations impose a greater restriction upon the use of buildings or land, or upon the height of buildings, or require larger open spaces or greater lot area per family, then are required or imposed by such easements, covenants or agreements between parties, or by such ordinances, rules, regulations or permits, the provisions of these regulations shall control. § 153.02.7 Repeal of Conflicting Ordinances
Upon passage of this Zoning Ordinance by the Common Council of the City of Garrett, Indiana, and approval by the Mayor, with publication and public hearings required by Indiana law, the original Zoning Ordinance adopted by the City of Garrett on December 16, 1964 and all amendments thereto, are hereby repealed. (Amended by Ordinance # 2293).
