§ 132.01 SMOKING PROHIBITED IN PUBLIC BUILDINGS.
No person shall smoke any tobacco product and no person shall smoke any other substance in any public building owned or occupied by the city or any of its departments, except as provided by § 132.02. This prohibition applies to City Hall, the Police/Fire Station, Wastewater Treatment Plant buildings, Water Treatment Plant buildings, Park Department buildings, swimming pool bathhouse, the recycling building, and any other buildings owned or occupied by the city. For each publicly owned or occupied building of the city or any of its departments, the department head of the department located in the building shall have the authority to designate one smoking area per building for employees only. The department head shall be responsible for identifying the smoking area and filing with the Mayor a report identifying the smoking area. The smoking area must be separated from non-smoking area by a wall, door or other partition; that is, it must be a separate room. The smoking area must be ventilated where feasible and situated so that air from the smoking area is not drawn into or across the remainder of the building. The smoking area must be clearly designated by appropriate signs visible to employees. The smoking area shall have ash trays, and other suitable containers for extinguishing smoking materials. Each department head shall have the authority, notwithstanding the provisions of this chapter, to not declare any area a smoking area and to require any employee who wishes to smoke to do so outside of the building. There shall be one smoking area in City Hall and one smoking area in the Police/Fire Station building, even though these buildings house more than one department.

§ 132.03 SMOKERS REMOVED FORM BUILDING.
Any person smoking in violation of the provisions of this chapter shall be removed from the building and permitted to return after the smoking materials have been extinguished. (Ord. 96-16, passed 8-20-96)
§ 132.04 SIGNS PROHIBITING SMOKING.
The Chief of Police is authorized to procure and posts signs containing the words "No Smoking-City Ordinance or the universal symbol for no smoking or other language that clearly prohibits smoking in connection with this chapter. (Ord. 96-16, passed 8-20-96)
Any person who violates the provisions of this chapter shall be subject to a fine of $30 as set forth in the schedule of civil penalties in § 35.03. (Ord. 96-16, passed 8-20-96)
